Welcome to Sand & See. In these Terms of Service the words "we", "us" and "our" refer to ABI Galaxy, trading as Sand & See. We operate this website and online store, including all related content, features, tools, products and services (together, the "Services").
These Terms of Service (the "Terms"), together with the policies linked from them, set out the rights and responsibilities that apply when you use the Services. Please read them carefully — they contain important information about your legal position, including sections on liability and dispute resolution.
By visiting, browsing, ordering from or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with them, please do not use the Services.
Our store is powered by Shopify, which provides the technology that allows us to offer the Services to you.
1. Who we are and who we sell to
Sand & See is an online store operated by ABI Galaxy, a company registered in The Netherlands under KvK (Chamber of Commerce) number 88473198. We sell to customers in Australia and dispatch all orders from our warehouse in Welshpool, Western Australia.

2. Eligibility and your account
By agreeing to these Terms you confirm that you are at least 18 years old, or that you have the permission of a parent or guardian to use the Services. If you allow a minor in your care to use the Services on a device you own or manage, you are responsible for their use of it.
To shop with us you may need to provide information such as your name, email address, delivery address and payment details. You confirm that the information you give us is accurate, current and complete, and that you are entitled to provide it.
If you create an account, you are responsible for keeping your login details secure and for everything that happens through your account. Please tell us straight away if you believe your account has been used without your permission. You may not sell, transfer or share your account with anyone else.
3. Our products
We take care to describe and photograph our products accurately. However, the colour, finish and appearance of a product on your screen depends on your device and its settings, so slight differences between the images and the item you receive are possible.
Product descriptions, specifications and availability may change at any time without notice. We may discontinue a product, or limit the quantity available to any customer, region or order, at our discretion.
Nothing in this section affects the consumer guarantees described in section 8.
4. Orders and acceptance
When you place an order you are making an offer to buy. Your order is accepted only when we send you a confirmation that your order has been accepted, and once your payment has been received and processed. An automated acknowledgement that your order has been received is not acceptance.
We may decline or cancel an order at our discretion — for example if the item is out of stock, if there was a pricing or description error, if we cannot verify your payment or delivery details, or if we suspect fraudulent or unauthorised activity. If we decline, change or cancel your order, we will contact you using the email address or phone number you provided, and any payment you have made will be refunded in full.
Please check your order carefully before you submit it. Once an order has been accepted and dispatched we may not be able to change or cancel it — see our Shipping Policy and Returns & Refunds Policy.
Our products are sold for personal and household use. You agree not to buy from us for the purpose of commercial resale or export.
5. Prices, GST and payment
All prices are shown in Australian dollars (AUD) and include GST where it applies. The price you pay is the price shown at the time you place your order and confirmed in your order confirmation email.
Prices, discounts and promotions can change at any time without notice. Changes do not affect orders that have already been accepted.
Promotions, discount codes and special offers may carry their own terms and conditions. Where those terms conflict with these Terms, the promotion terms apply to that promotion.
By submitting payment details you confirm that you are authorised to use the payment method, that the details are correct and complete, and that the payment will be honoured by your bank or card issuer. You agree to keep your payment and contact details up to date so we can complete your order and reach you if needed.
6. Shipping and delivery
Delivery times shown on our website are estimates, not guarantees. We are not responsible for delays caused by our carrier, by weather, by public holidays or by other events outside our reasonable control, although we will always help you follow up on a delayed parcel.

7. Returns, refunds and exchanges
You have 30 days from receiving your order to request a return. The conditions, the process and who pays for return shipping are set out in full in our Returns & Refunds Policy, which forms part of these Terms.
8. Your rights under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a term of these Terms would be unlawful under the Australian Consumer Law, that term does not apply to you.
9. Intellectual property
The Services and their contents — including text, product descriptions, photographs, graphics, video, audio, layout, design and their selection and arrangement — are owned by ABI Galaxy or its licensors and are protected by Australian and international copyright, trademark and other intellectual property laws.
You may use the Services for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, modify, adapt, publicly display, sell or exploit any part of the Services without our prior written permission.
"Sand & See", our logos, and our product and service names are trademarks of ABI Galaxy. You may not use them without our written permission. Shopify's name, logo and product names are trademarks of Shopify. All other names, logos and marks appearing on the Services belong to their respective owners.
Nothing in these Terms grants you any licence or right in the intellectual property of ABI Galaxy, Shopify or any third party except as expressly stated. All rights not expressly granted are reserved.
10. Third-party tools and links
The Services may give you access to tools, apps or features provided by third parties that we do not control or monitor. These are made available "as is" and "as available", without warranties of any kind and without any endorsement by us. Using them is at your own risk, and you should read the third party's own terms before you do.
The Services may also contain links to, or embedded content from, websites operated by third parties. We are not responsible for the content, accuracy, products or practices of those websites. If you leave our Services to visit them, you do so at your own risk, and any questions or complaints about their products or services should be directed to them.
New features, tools and resources that we add to the Services in future are also covered by these Terms.
11. Our relationship with Shopify
Sand & See is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with ABI Galaxy, trading as Sand & See. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sand & See, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Sand & See.
12. Privacy
All personal information we collect through the Services is handled in line with our Privacy Policy. Some personal information may also be subject to Shopify's own privacy policy. By using the Services you confirm that you have read and understood how your information is used.
Because our store is hosted by Shopify, Shopify collects and processes information about your access to and use of the Services in order to provide and improve them. Information you submit through the Services may be transmitted to and shared with Shopify and with service providers located in countries other than Australia. Our Privacy Policy explains this in more detail.
13. Reviews and feedback
If you send us ideas, suggestions, reviews, photographs, proposals or any other content (together, "Feedback"), you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, adapt, publish, distribute and display that Feedback in any medium and for any purpose, including promoting our products and improving the Services.
You confirm that you own or have the rights to any Feedback you send us, that you have disclosed any payment or incentive you received in connection with it, and that it does not infringe anyone else's rights or contain unlawful, abusive, defamatory, obscene or misleading material or malicious code. You may not misrepresent who you are or where your Feedback comes from.
We are not obliged to keep Feedback confidential, to pay for it, or to respond to it. We may — but are not required to — edit, decline to publish or remove Feedback that we consider unlawful, offensive or in breach of these Terms. You remain solely responsible for the Feedback you submit.
14. Errors, inaccuracies and omissions
Occasionally information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability. We reserve the right to correct any such error and to change or update information, or to cancel an affected order, at any time and without prior notice — including after an order has been submitted. If we cancel an order for this reason, we will refund you in full.
15. Acceptable use
You may use the Services for lawful purposes only. You must not use the Services, directly or indirectly:
- for any unlawful, fraudulent or malicious purpose;
- to breach any applicable law, regulation or local rule;
- to infringe our intellectual property rights or those of anyone else;
- to harass, abuse, threaten, defame or harm any person, including our staff;
- to submit false, misleading or deceptive information;
- to send unsolicited advertising, spam or chain messages;
- to impersonate any other person or organisation;
- to interfere with anyone else's use of the Services.
You also agree not to upload viruses or malicious code, to copy, resell or exploit any part of the Services, to harvest or track other people's personal information, to scrape, crawl or spider the Services, or to interfere with or bypass their security features.
We may suspend or terminate your access to the Services at any time if we reasonably believe you have breached this section.
16. Termination
We may end this agreement or withdraw your access to the Services (or any part of them) at any time, at our discretion. Any amounts you owe us up to the date of termination remain payable.
Sections that by their nature should continue to apply after termination will do so — including Intellectual property, Reviews and feedback, Disclaimer of warranties, Limitation of liability, Indemnity, Severability, Waiver and entire agreement, Assignment, Governing law and Privacy.
17. Disclaimer of warranties
The information on the Services is provided for general information only. We do not warrant that it is complete, accurate or up to date at all times, and any reliance you place on it is at your own risk.
Except as expressly stated by us, and subject always to section 8, the Services and the products offered through them are provided "as is" and "as available", without representations, warranties or conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title or non-infringement. We do not guarantee that the Services will be uninterrupted, secure, timely or free of errors.
This section does not exclude or limit any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
18. Limitation of liability
To the fullest extent permitted by law, and subject always to section 8, neither ABI Galaxy nor our directors, officers, employees, affiliates, agents, contractors, service providers or licensors — nor those of Shopify — will be liable for any indirect, incidental, special, punitive or consequential loss or damage of any kind, including loss of profit, revenue, savings or data, arising from your use of the Services or of any product purchased through them, whether the claim is based in contract, negligence, strict liability or otherwise, even if we were advised such loss was possible.
Where our liability cannot be excluded but may be limited, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.
Nothing in this section excludes or limits our liability where it cannot lawfully be excluded or limited, including under the Australian Consumer Law.
19. Indemnity
You agree to indemnify and hold harmless ABI Galaxy, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors and service providers against any loss, damage, liability or claim, including reasonable legal costs, brought by a third party and arising from (1) your breach of these Terms or any policy they refer to, (2) your breach of any law or of a third party's rights, or (3) your use of the Services.
We will notify you of any claim covered by this indemnity. We may take control of the defence and settlement of the claim at your expense, but we will not agree to a settlement that imposes a non-financial obligation on you without your consent, which you will not unreasonably withhold. You agree to cooperate with us in defending any such claim.
20. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will apply to the fullest extent permitted by law, and the unenforceable part will be treated as removed. The remaining provisions stay in full force and effect.
21. Waiver and entire agreement
If we do not enforce a right or provision of these Terms, that does not mean we waive it.
These Terms, together with the policies published on our website, form the entire agreement between you and us about your use of the Services, and replace any earlier agreements, communications or proposals between us, whether written or spoken — including earlier versions of these Terms.
Any ambiguity in these Terms will not be interpreted against us simply because we drafted them.
22. Assignment
You may not transfer, assign or delegate these Terms or any of your rights or obligations under them without our prior written consent. Any attempt to do so is void. We may transfer or assign these Terms and our rights and obligations under them without your consent, for example as part of a sale or reorganisation of our business.
23. Governing law and disputes
These Terms and any agreement under which we supply the Services to you are governed by the laws of The Netherlands, where ABI Galaxy is established.
If you are a consumer resident in Australia, this does not deprive you of the protection of the mandatory consumer laws of Australia, including the Australian Consumer Law, and you may also bring proceedings in the courts of the Australian state or territory in which you live.
If something goes wrong, please contact us first — most issues are resolved quickly and informally. If you are not satisfied with our response, you may also contact the Australian Competition and Consumer Commission (ACCC) or your state or territory consumer protection agency.
24. Headings
The headings in these Terms are for convenience only and do not affect how the Terms are interpreted.
25. Changes to these Terms
The most current version of these Terms is always available on this page.
We may update, change or replace any part of these Terms at our discretion by publishing the updated version on our website. It is your responsibility to check this page from time to time. Where a change is material we will notify you as required by applicable law, and the change takes effect on the date stated in that notice. By continuing to use the Services after an update is published, you accept the revised Terms.
